End-User License Agreement

1. Introduction

This End-User License Agreement ("EULA") is a legal agreement between you ("Player", "you", or "your") and A.R.C Foundation Studios US ("A.R.C", "we", "us", or "our") governing your use of the Stardust Universe game client, launcher, related downloadable content, virtual items, and any updates (collectively, the "Software"). By installing, copying, or using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.

2. License Grant

Subject to your compliance with this EULA, the Terms of Service, and any applicable payment obligations, A.R.C grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use one copy of the Software on devices that you own or control solely for personal, non-commercial entertainment purposes.

3. License Restrictions

You may not:

  • Modify, translate, adapt, or create derivative works of the Software except as expressly permitted by us in writing.
  • Reverse engineer, decompile, or disassemble the Software except where such activity is expressly permitted by law.
  • Circumvent, disable, or interfere with security features or digital rights management.
  • Use the Software for commercial purposes, including running a service bureau, hosting, or renting the Software to others.
  • Use bots, cheats, automation software, or any unauthorized third-party program that modifies or interferes with gameplay.
  • Access or use the Software outside the regions where A.R.C has made it available or in violation of applicable export laws.

4. Accounts and Authentication

Access to certain features may require a valid Stardust Universe account. You are responsible for safeguarding your login credentials and for all activity on your account. Use of the Software is also subject to the Terms of Service and community guidelines.

5. Virtual Goods and Game Currency

The Software may offer virtual currency or items. Virtual goods have no real-world monetary value, cannot be exchanged for real currency, and are non-transferable except as permitted within the Software. All purchases of virtual goods are final unless otherwise required by law. We may modify or discontinue virtual goods at any time without liability.

6. User-Generated Content

You may create or upload user-generated content ("UGC") such as mods, skins, or chat messages where enabled. By submitting UGC, you grant A.R.C a worldwide, royalty-free, perpetual license to use, host, reproduce, modify, distribute, and display the UGC in connection with the Software. You represent that your UGC does not infringe the rights of third parties or violate applicable law. We reserve the right to remove UGC at our discretion.

7. Updates and Patches

We may deploy updates, patches, or modifications to the Software that must be installed for you to continue using the Software. These updates may change features, balance, or functionality. Failure to install required updates may render the Software unusable.

8. Data Collection and Monitoring

The Software may collect technical information about your device, operating system, gameplay statistics, crash logs, and use of anti-cheat measures. This data is processed in accordance with our Privacy Policy and helps us improve stability, security, and gameplay integrity.

9. Termination

This license is effective until terminated. We may suspend or terminate your access to the Software immediately if you violate this EULA, the Terms of Service, or applicable law. You may terminate the license at any time by uninstalling the Software. Upon termination, you must cease all use and delete all copies of the Software. Sections that by their nature should survive termination will remain in effect.

10. Ownership and Intellectual Property

The Software is licensed, not sold. A.R.C and its licensors retain all right, title, and interest in and to the Software and all associated intellectual property rights. All trademarks, logos, and service marks are the property of their respective owners.

11. Limited Warranty and Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. A.R.C DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, A.R.C, ITS AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR THE SOFTWARE DURING THE SIX MONTHS PRECEDING THE CLAIM OR USD $50, WHICHEVER IS GREATER.

13. Indemnity

You agree to indemnify, defend, and hold harmless A.R.C, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of this EULA or misuse of the Software.

14. U.S. Government Rights

The Software is provided with restricted rights. Use, duplication, or disclosure by the U.S. Government is subject to the restrictions set forth in FAR 52.227-19 and DFARS 227.7202 or successor regulations.

15. Export Control

You must comply with all applicable export and re-export control laws and regulations. You represent that you are not located in a country subject to U.S. Government embargo and are not on any U.S. Government list of prohibited parties.

16. Governing Law and Dispute Resolution

This EULA is governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising under this EULA will be resolved pursuant to the arbitration provisions described in the Terms of Service.

17. Severability and Assignment

If any provision of this EULA is held invalid or unenforceable, the remaining provisions will continue in full force. You may not assign or transfer this EULA without our prior written consent. We may assign this EULA to an affiliate or successor in interest.
